Conditions Générales d’Utilisation (CGU) – KioStore

1. Objet

Les présentes Conditions Générales d’Utilisation (ci-après « CGU ») régissent l’accès et l’utilisation de la plateforme KioStore, solution SaaS permettant la création, la gestion et l’exploitation de boutiques en ligne.

En créant un compte ou en utilisant la plateforme, vous acceptez pleinement les présentes CGU.

 

2. Définitions

Plateforme : Solution logicielle KioStore accessible en ligne.

Utilisateur / Marchand : Toute personne physique ou morale utilisant KioStore pour exploiter une boutique.

Client final : Toute personne effectuant un achat sur une boutique créée via KioStore.

Services : Ensemble des fonctionnalités proposées par KioStore.

 

3. Accès à la plateforme

L’accès aux services nécessite :

  • La création d’un compte

     

  • La fourniture d’informations exactes et complètes

     

  • L’acceptation des CGU

     

4. Nature des services

KioStore fournit une infrastructure technique uniquement.

KioStore n’est pas :

  • Le vendeur des produits

     

  • L’agent commercial des marchands

     

  • Responsable des transactions entre marchand et client

     

Le marchand est seul responsable :

  • De ses produits

     

  • De ses prix

     

  • De ses descriptions

     

  • De la livraison

     

  • Du service client

     

  • Des remboursements

     

  • Du respect des lois applicables

     

5. Obligations du Marchand

Le marchand s’engage à :

  • Respecter toutes les lois commerciales et fiscales

     

  • Ne pas vendre de produits illégaux

     

  • Fournir des informations claires aux clients

     

Il est strictement interdit de vendre :

  • Produits contrefaits

     

  • Produits dangereux ou interdits

     

  • Armes, drogues, contenus illégaux

     

  • Produits incitant à la haine ou à la violence

     

 

6. Compte et sécurité

Le marchand est responsable :

  • De la confidentialité de son mot de passe

     

  • De toutes les activités effectuées via son compte

     

7. Propriété intellectuelle

A. Propriété de KioStore

La plateforme, son code, son design, ses logos, son architecture sont protégés par le droit de la propriété intellectuelle.

Il est interdit de :

  • Copier la plateforme

     

  • La reproduire

     

B. Contenu du marchand

Le marchand conserve la propriété de son contenu (textes, images, produits).

Il accorde à KioStore une licence non exclusive permettant :

  • L’hébergement

     

  • L’affichage

     

  • L’utilisation pour le fonctionnement des services

     

8. Limitation de responsabilité

KioStore ne pourra être tenue responsable :

  • Des pertes financières du marchand

     

  • Des litiges avec les clients

     

  • Des problèmes de livraison

     

  • Des pertes de données causées par le marchand

     

  • Des interruptions liées à des services tiers

     

9. Résiliation

Résiliation par le marchand

Avant suppression, le Marchand dispose de 30 jours pour exporter ses données. Passé ce délai, KioStore n’est plus tenu de les conserver.

Résiliation par KioStore

Nous pouvons suspendre ou résilier un compte en cas de :

  • Violation des CGU

     

  • Activité frauduleuse

     

  • Atteinte à la réputation de la plateforme

     

En cas de fraude grave, la suppression peut être immédiate sans préavis.

 

10. Protection des données

Le traitement des données est régi par notre Politique de Confidentialité.

Le marchand reste responsable des données de ses clients.

 

11. Modification des CGU

KioStore peut modifier les présentes CGU à tout moment.

Les modifications entrent en vigueur dès leur publication.

La poursuite de l’utilisation vaut acceptation.

 

12. Droit applicable et juridiction

Les présentes CGU sont régies par le droit algérien.

Tout litige sera soumis aux tribunaux compétents en Algérie, sauf disposition légale contraire.

 

General Terms of Use (GTC) – KioStore

1. Object These General Terms of Use (hereinafter “GTC”) govern the access to and use of the KioStore platform, a SaaS solution for creating, managing, and operating online stores. By creating an account or using the platform, you fully accept these GTC.

2. Definitions

  • Platform: The KioStore software solution accessible online.

  • User / Merchant: Any natural or legal person using KioStore to operate a store.

  • End Client: Any person making a purchase on a store created via KioStore.

  • Services: All features offered by KioStore.

3. Access to the Platform Access to the services requires:

  • Creating an account.

  • Providing accurate and complete information.

  • Accepting the GTC.

4. Nature of Services KioStore provides a technical infrastructure only. KioStore is not:

  • The seller of the products.

  • The commercial agent for merchants.

  • Responsible for transactions between the merchant and the client.

The merchant is solely responsible for:

  • Their products, prices, and descriptions.

  • Delivery, customer service, and refunds.

  • Compliance with applicable laws.

5. Merchant Obligations The merchant agrees to:

  • Respect all commercial and tax laws.

  • Not sell illegal products.

  • Provide clear information to clients.

It is strictly forbidden to sell:

  • Counterfeit products.

  • Dangerous or prohibited products.

  • Weapons, drugs, illegal content.

  • Products inciting hatred or violence.

6. Account and Security The merchant is responsible for:

  • The confidentiality of their password.

  • All activities performed via their account.

7. Intellectual Property

  • A. KioStore Ownership: The platform, its code, design, logos, and architecture are protected by intellectual property rights. Copying or reproducing the platform is prohibited.

  • B. Merchant Content: The merchant retains ownership of their content (texts, images, products). They grant KioStore a non-exclusive license allowing for hosting, displaying, and using the content for the operation of the services.

8. Limitation of Liability KioStore cannot be held responsible for:

  • The merchant’s financial losses.

  • Disputes with clients or delivery issues.

  • Data loss caused by the merchant.

  • Interruptions related to third-party services.

9. Termination

  • Termination by the Merchant: Before deletion, the merchant has 30 days to export their data. After this period, KioStore is no longer required to keep it.

  • Termination by KioStore: We may suspend or terminate an account in case of: violation of the GTC, fraudulent activity, or damage to the platform’s reputation. In cases of serious fraud, deletion may be immediate without notice.

10. Data Protection Data processing is governed by our Privacy Policy. The merchant remains responsible for their clients’ data.

11. Modification of the GTC KioStore may modify these GTC at any time. Modifications come into effect upon publication. Continued use constitutes acceptance.

12. Applicable Law and Jurisdiction These GTC are governed by Algerian law. Any dispute will be submitted to the competent courts in Algeria, unless otherwise provided by law.

شروط الاستخدام العامة (CGU) – KioStore

1. الموضوع تُعد شروط الاستخدام العامة هذه (يُشار إليها فيما بعد بـ “شروط الاستخدام”) بمثابة العقد الذي يحكم الوصول إلى منصة KioStore واستخدامها، وهي حل برمجي (SaaS) مخصص لإنشاء وإدارة وتشغيل المتاجر الإلكترونية. بمجرد إنشاء حساب أو استخدام المنصة، فإنك توافق بشكل كامل على هذه الشروط.

2. التعريفات

  • المنصة: الحل البرمجي KioStore المتاح عبر الإنترنت.

  • المستخدم / التاجر: أي شخص طبيعي أو اعتباري يستخدم KioStore لتشغيل متجر إلكتروني.

  • العميل النهائي: أي شخص يقوم بعملية شراء من متجر تم إنشاؤه عبر KioStore.

  • الخدمات: مجموع الوظائف والميزات التي توفرها KioStore.

3. الوصول إلى المنصة يتطلب الوصول إلى الخدمات ما يلي:

  • إنشاء حساب.

  • تقديم معلومات دقيقة وكاملة.

  • الموافقة على شروط الاستخدام.

4. طبيعة الخدمات توفر KioStore البنية التحتية التقنية فقط. ولا تعتبر KioStore:

  • بائعاً للمنتجات.

  • وكيلاً تجارياً للتجار.

  • مسؤولة عن المعاملات التي تتم بين التاجر والعميل.

يتحمل التاجر وحده المسؤولية عن:

  • منتجاته، أسعاره، وأوصافه.

  • عمليات التوصيل وخدمة العملاء.

  • سياسات الاسترداد والامتثال للقوانين المعمول بها.

5. التزامات التاجر يتعهد التاجر بـ:

  • احترام جميع القوانين التجارية والضريبية.

  • عدم بيع منتجات غير قانونية.

  • تقديم معلومات واضحة للعملاء.

يُمنع منعاً باتاً بيع:

  • المنتجات المقلدة.

  • المنتجات الخطرة أو المحظورة.

  • الأسلحة، المخدرات، أو المحتويات غير القانونية.

  • المنتجات التي تحرض على الكراهية أو العنف.

6. الحساب والأمان يتحمل التاجر المسؤولية عن:

  • سرية كلمة المرور الخاصة به.

  • جميع الأنشطة التي تتم من خلال حسابه.

7. الملكية الفكرية أ. ملكية KioStore: المنصة، رمزها البرمجي، تصميمها، شعاراتها، وهيكلها محمية بموجب قوانين الملكية الفكرية. يُمنع نسخ المنصة أو إعادة إنتاجها. ب. محتوى التاجر: يحتفظ التاجر بملكية محتواه (نصوص، صور، منتجات). ويمنح KioStore ترخيصاً غير حصري يسمح بـ: استضافة المحتوى، عرضه، واستخدامه لضمان تشغيل الخدمات.

8. تحديد المسؤولية لا يمكن تحميل KioStore المسؤولية عن:

  • الخسائر المالية للتاجر.

  • النزاعات مع العملاء أو مشاكل التوصيل.

  • فقدان البيانات الناتج عن أخطاء التاجر.

  • الانقطاعات المتعلقة بخدمات الطرف الثالث.

9. إنهاء التعاقد

  • إنهاء التعاقد من قبل التاجر: قبل حذف الحساب، يمتلك التاجر مهلة 30 يوماً لتصدير بياناته. بعد هذه الفترة، لن تكون KioStore ملزمة بالاحتفاظ بها.

  • إنهاء التعاقد من قبل KioStore: يمكننا تعليق أو إنهاء الحساب في حالة: انتهاك شروط الاستخدام، الأنشطة الاحتيالية، أو الإضرار بسمعة المنصة. في حالات الاحتيال الجسيم، قد يتم الحذف فوراً دون إشعار مسبق.

10. حماية البيانات تخضع معالجة البيانات لسياسة الخصوصية الخاصة بنا. ويظل التاجر مسؤولاً عن بيانات عملائه.

11. تعديل شروط الاستخدام يجوز لـ KioStore تعديل هذه الشروط في أي وقت. تدخل التعديلات حيز التنفيذ فور نشرها، ويعتبر استمرار استخدام المنصة بمثابة موافقة على هذه التعديلات.

12. القانون الواجب التطبيق والاختصاص القضائي تخضع شروط الاستخدام هذه للقانون الجزائري. وأي نزاع يُعرض على المحاكم المختصة في الجزائر، ما لم ينص القانون على خلاف ذلك.
